Mission

Our mission is to:
➢ Provide timely, impartial and accurate processing of complaints and violations filed with the City of Breckenridge Municipal Court.
➢ Courteously respond to requests for information from the public.
➢ Perform responsible collection of assessed fines and fees and efficient docketing of cases for adjudication.

The Breckenridge Municipal Court is responsible for the adjudication of Class C misdemeanor violations of local, state and federal laws punishable by fine only; other sanctions may be included for certain offenses.  The court conducts preliminary and pretrial hearings and trials, collects fines and court costs and issues warrants of arrest and search.

All cases are heard at 120 West Elm Street in the Municipal Court building.  The law requires that you make an appearance either in person or by mail.

If you were issued a citation, you must appear on or before your appearance date to enter a plea, pay your fine and court costs or set a court date.  Failure to do so may result in a warrant being issued for your arrest.

Payment is expected at time of assessment.

 

Driver Safety Course (DSC)

(NOT for Commercial Driver’s License (CDL) holders

You may be able to request that a charge be dismissed by taking a Driving Safety Course.  However, you will lose that right if you do not provide written notice to the court of your desire to do so, on or before your appearance date.  A written notice is a notarized affidavit of eligibility or sworn request.

DO NOT TAKE THE COURSE UNTIL YOU HAVE OBTAINED PERMISSION FROM THE COURT.

ELIGIBILITY REQUIREMENTS FOR DSC ARE AS FOLLOWS:

  1. You must enter a written plea of guilty or no contest
  2. You must possess a valid Texas Driver’s License
  3. You must possess Texas Liability Insurance valid the day of your request
  4. You must pay the State Court Costs and administrative fee of $100.00 or $125.00 if violation occurred in a school zone
  5. You cannot be charged with speeding in excess of 24 miles per hour above speed limit
  6. You cannot be currently taking the course for another citation
  7. Your driving record cannot reflect completion of a DSC within the twelve months preceding the date of the alleged offense

YOU CAN REQUEST YOUR TEXAS DRIVING RECORD ONLINE HERE.

You must provide the court with a sworn affidavit of eligibility, listing all seven requirements that must be notarized and filed with the court by your court date.  If you appear in person at the Court, please bring your valid Texas Driver’s License, proof of insurance (showing that you were covered the date you received the citation and the date of your request), court costs and administrative fee.  The Court Clerk will notarize the court’s affidavit for you at no extra charge.  Upon court approval to take the course, you will have ninety days in which to provide the court with the two following documents:

  1. The “court certificate” of completion (signed) of the driving safety course from an agency approved by the State of Texas.
  2. A certified copy of your driving record as maintained by the Texas Department of Public Safety.  Please request this immediately, as it may take several weeks to receive.

If these two documents are not filed within the court within ninety days, you may be responsible for payment, thereby having the offense reported to your driver’s record and a warrant may be issued for your arrest.

 

Dismissable Citations

If you received a citation for the following:

  1. Failure to Show Proof of Financial Responsibility (No Insurance)
  2. No Driver’s License
  3. Failure to Display a Driver’s License

You may request that the citation be dismissed if you can submit valid proof of insurance or valid driver’s license before your court date.  Only sufficient proof that was valid at the date and time of the issuance of the citation can be filed with the court for dismissal.

  1. Expired Driver’s License
  2. Expired Motor Vehicle Registration
  3. Expired Motor Vehicle Inspection (Expired for less than 60 days)

You may request that the ticket be dismissed if the violation is corrected on or before your appearance date.  To request a dismissal, you must enter a written plea of Guilty or No Contest, provide the court with receipt for each renewal, and pay the required $20.00 fee for each corrected violation.  Violations not corrected on or before your appearance date and presented to the court as stated at the bottom left hand corner of the citation will not be accepted for dismissal.  The dismissal fee is $20.00.

Insurance Affidavit  (READ CAREFULLY)

A second or subsequent conviction of an offense under the Texas Motor Vehicle Safety Responsibility Act will result in the suspension of your driver’s license and motor vehicle registration; unless you file and maintain proof of financial responsibility with the Department of Public Safety for two years from the date of conviction.  The Department of Public Safety may waive the requirement to file proof of financial responsibility, if you file satisfactory evidence with the Department showing that at the time the citation was issued, the vehicle was covered by a liability insurance policy or that you were exempt from the requirement to provide financial responsibility.

Payment Plan Information

A defendant must qualify for a time payment agreement and the request must be made in person.  There will be an additional $25.00 fee added to the fine.  The additional fee is required by the State and cannot be waived by the Court.  Time Pay Agreements are not available by phone, mail, fax or online.

Payments can be paid by cash if paying in person at the Court.  Cashier’s checks and money orders if paying by mail or by credit or debit card if you are paying online.
